THE TCPA

The Telephone Consumer Protection Act (TCPA) was created by Congress to protect you from unwanted calls, texts, and faxes- (yes, people still send faxes).  The TCPA made unwanted calls/texts to residential phone lines illegal and created the National Do Not Call List (NDNCL). The idea was that consumers could put their phone numbers on the NDNCL and telemarketers would know which numbers they could not call. As you know, this list does not stop the telemarketers and spammers, but it does give consumers the right to sue violators of the TCPA who ignore the law and call people who do not want to be called. The TCPA also makes it illegal to use an auto dialer or prerecorded voice to call consumers. The best part about the TCPA is that it puts the power in the hands of consumers like you. There are two private rights of action under the TCPA and people who receive illegal calls/texts/faxes can sue the responsible parties for up to $1,500.00 per violation. These TCPA violators do everything they can to avoid these suits- except stopping the calls of course. If you are receiving annoying calls, texts, or faxes- it is your right to fight back! Wrong Number Calls/Texts

Are you receiving calls and texts meant for someone else? Those may be violations of the TCPA. Companies are supposed to check a database to avoid calling and texting reassigned phone numbers. 

Do Not Call List

Telemarketers are prohibited from calling your residential number (home or cell) if it is listed on the National Do Not Call List. Visit donotcall.gov to put your phone numbers on the list and to learn more. Make sure to save the email confirmation.

Prerecorded Messages

The TCPA makes it illegal to call you with a prerecorded message or voice. This includes "A.I." bots and sound boards. 

Take Action

Telemarketers make it difficult for you to identify them because they know their calls are not lawful. However, if they want to sell you something, they eventually have to give you some authentic company information. First, make sure you number is on the NATIONAL DO NOT CALL LIST. Once you have done that, here are a few tips to ID the perpetrators:

Telemarketers will usually hang up if they think you are not interested, not qualified, or trying to ID them. Oftentimes, if you play along and ask friendly questions like; "Do you have a website?", "Where are you located?", or "What is your company called?" our attorneys may be able to use this info to find the callers.  

Notes

Take Notes

In many states, it is perfectly legal to record your own phone calls. If recording the calls is not an option, save all texts and take detailed notes of each call including the phone number, whether a prerecorded message was played, any company names, representative names, websites, call back numbers, addresses, call times, etc. The more the better.
